Bloom by Day (the "Service") is an experimental, free beta tool that displays satellite-derived ocean information — algae bloom indicators, water-clarity estimates, surface currents and related conditions. It is operated by an independent developer based in Queensland, Australia ("we", "us").
By accessing or using the Service, you agree to these Terms of Use. If you do not agree, please do not use the Service.
Bloom by Day is for general, personal information only. It is not a navigation, diving, boating or safety tool, and must never be relied on for any decision affecting safety of life. Always verify conditions yourself using official sources and your own judgement before entering the water or making any decision on the water.
The Service is provided in beta. Features are under active development and may change, break, or be removed at any time. The data shown is experimental and processed automatically; it may contain errors, omissions, gaps, delays, or inaccuracies, and may be unavailable without notice.
The Service is intended for general interest and informational use only. It is not designed or certified for, and must not be used as a basis for:
Water activities are inherently dangerous. Conditions can change rapidly and differ from any model or satellite estimate. You are solely responsible for your own safety and for independently verifying all conditions with official and local sources before acting.
The Service and all data are provided "as is" and "as available", without warranties of any kind, whether express or implied, to the maximum extent permitted by law. We do not warrant that the Service will be accurate, complete, current, reliable, uninterrupted, error-free, or fit for any particular purpose.
The Service combines data from third-party sources, which may include the Copernicus Marine Service (Copernicus-GlobColour), Open-Meteo, and map tiles from OpenStreetMap and CARTO. We do not control and are not responsible for the accuracy, availability or licensing of third-party data. Such data is used subject to the terms of its providers, and credit is given where required.
You acknowledge that you use the Service entirely at your own risk, and that any reliance on the information it provides is your own decision and responsibility.
To the maximum extent permitted by law, we will not be liable for any loss, injury, damage or harm of any kind — whether direct, indirect, incidental, special, consequential or otherwise — arising out of or in connection with your use of, or inability to use, the Service or its data, even if we have been advised of the possibility of such loss. As the Service is provided free of charge, you agree that this allocation of risk is reasonable.
Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy you may have under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law, or any other law that cannot lawfully be excluded. Where our liability for a failure to comply with a consumer guarantee can be limited (and the goods or services are not of a kind ordinarily acquired for personal, domestic or household use), our liability is limited, at our option, to re-supplying the relevant service or paying the cost of having it re-supplied. To the extent permitted by law, all other warranties, guarantees and conditions are excluded.
The Service is offered for your personal, non-commercial use. You agree not to misuse it, including by attempting to disrupt or overload it, scraping or redistributing its data in breach of the underlying data providers' terms, or using it for any unlawful purpose.
The Service's design, branding, original code and presentation are owned by us. Underlying satellite and map data remain the property of their respective providers. You are granted a limited, personal, revocable licence to use the Service for its intended purpose only.
The Service does not require an account and does not ask you to provide personal information to use it. We use privacy-respecting, aggregate analytics to understand general usage and improve the Service. Your device and browser may share standard technical information (such as approximate location and device type) as part of normal web use. We do not sell your data.
We may modify, suspend or discontinue any part of the Service, and may update these Terms, at any time without notice. Continued use of the Service after changes take effect means you accept the updated Terms. The "effective" date above shows when these Terms were last revised.
These Terms are governed by the laws of Queensland, Australia. You agree to the non-exclusive jurisdiction of the courts of Queensland and the Commonwealth of Australia. If any provision is found unenforceable, the remaining provisions continue in full force.
